Terms and Conditions
Last updated: 21 October 2026
These terms apply to website design, development and related support services supplied by Clever Web Design (“we”, “us”). By accepting a written proposal or asking us to begin work, you (“you”, “the client”) agree to these terms together with the scope and price in that proposal.
Important: These are general service terms, not legal advice. Your accepted proposal may set project-specific details. Nothing in these terms limits rights that cannot legally be limited, including applicable consumer rights.
1. Services and project scope
We provide website design, development, redesign, Shopify setup and related support as agreed in a written proposal. The proposal will describe the deliverables, price, payment arrangements and any project-specific milestones. Work outside the agreed scope, including additional pages, features or redesigns, may require a separate quote. We will obtain your approval before carrying out chargeable additional work.
Project dates are estimates unless expressly agreed otherwise. Delivery may depend on receiving your content, feedback, decisions and account access in good time.
2. Fees and third-party services
You pay project fees as stated in the proposal or invoice. Domain registration, hosting, Shopify subscriptions and other third-party platform or service fees are separate and are paid by you directly to the relevant provider. Provider prices, terms and availability may change.
We can assist with setup as agreed for the project. Third-party services are governed by their own terms, and we are not responsible for their outages, changes, charges or policies.
3. Complimentary post-launch support
Each website build includes one month of complimentary post-launch support starting on the date the website goes live. It covers small text and image updates and post-launch assistance or questions. It does not include new pages, new features, redesigns, or third-party fees such as domain, hosting or Shopify charges.
After the complimentary month, the optional care plan is £25 per month, unless a different price is agreed in writing. The plan covers only the services described on our website or in your proposal. Any service may depend on the capabilities and terms of your hosting or platform provider.
4. Your responsibilities and supplied materials
You will provide accurate information, approvals and materials reasonably needed for the project, and ensure you have permission to use any text, photographs, logos, fonts or other materials you supply. You are responsible for the accuracy and legality of your business claims, prices, policies and published content. Delays in receiving required materials or decisions may affect the estimated schedule.
We may rely on information and approvals you provide. Please review the website carefully before launch and notify us of any errors.
5. Copyright and intellectual property
You retain ownership of materials you provide. Once all agreed project fees have been paid, rights in the bespoke website design and code created specifically for your project will transfer to you to the extent those rights can be transferred.
This transfer does not include our pre-existing tools, reusable methods or materials, nor third-party software, open-source components, fonts, stock images, platform features or other licensed materials. Those remain subject to their respective licences and terms. We will identify material restrictions known to us that affect the agreed deliverables.
Unless we agree otherwise in writing, we may identify the completed project in our portfolio and show non-confidential screenshots or a link to the live website. You may ask us not to do so before publication.
Copyright and permitted use of this website are explained in our Copyright Notice.
6. Reviews, launch and ongoing operation
We will build the agreed deliverables with reasonable care and aim for them to work across current desktop, tablet and mobile browsers. The website may rely on third-party hosting, browsers, platforms or services that we do not control. Search-engine placement, visitor numbers, enquiries, sales and uninterrupted availability cannot be guaranteed.
After launch, you are responsible for keeping your domain, hosting and platform accounts active and for managing access credentials, unless an ongoing service expressly includes that task.
7. Cancellations and changes
If you want to pause, change or cancel a project, contact us promptly in writing. We will discuss work already completed and any outstanding fees in line with the proposal and applicable law. If you are a consumer, any statutory cancellation or refund rights that apply to your contract remain unaffected; specific rights can depend on when work starts and how the contract was made.
8. Liability
Nothing in these terms excludes or restricts liability where the law does not allow it, including liability for death or personal injury caused by negligence, fraud, or your applicable statutory rights as a consumer.
To the extent permitted by law, we are not responsible for losses caused by inaccurate or unlawful materials you supply, your failure to maintain third-party accounts, or the acts, omissions or outages of providers outside our reasonable control. We are not liable for indirect or consequential business losses where the law permits that exclusion. Any other applicable liability limits must be set out in your written proposal and comply with the law.
9. Privacy and cookies
Our Privacy Notice explains how enquiries and project information are handled. Our Cookie Policy describes the limited browser storage and optional external content used on this website.
